A Critical Analysis of Land Acquisition Act 1894 in the light of Islamic Jurisprudence and Contemporary Legal Context

Abstract

This study scrutinizes the concept of land acquisition and its historical evolution in the Sub-continent while highlighting the legal issues involved in the Land Acquisition Act 1894.  The Act is to-date the fundamental legislation on the subject. Land acquisition is a confiscatory statute designed to deprive citizens of their valuable rights in the property through coercive measures of the State exercising authority under a statute. By investigating the finances of the land market and the complications in land estimating. This study looks into the part of state intervention, exclusively through conflicts between the ‘giving’ state, which does terrestrial transformations, and the ‘taking’ state, which obtains the property. This research also analyzes the effect of the various laws governing the issue of Land Acquisition and its impact on stakeholders. It also covers the role of enforcing agencies dealing with the problem of Land Acquisition and rehabilitation and resettlement of the landowners and livelihood losers. Furthermore, the study investigates the causes and factors leading to the Land Acquisition for public as well as private purposes.
