Abstract

The increasing number of transplantation surgeries has led to a scarcity of organs, prompting scholars to reevaluate the current understanding of human body ownership. Some scholars advocate financial incentives to enhance the availability of organs for transplantation, arguing that such inducements could increase supply. While this principle aligns with economic theories, its adequacy from a jurisprudential perspective remains contentious. Allowing financial compensation for organs implies the recognition of the human body as property, as the sale of an object necessitates ownership. This issue has spurred significant debate among jurists worldwide, including in the Islamic context, where scholars are exploring key questions: Do individuals possess ownership over their own bodies? Can the human body serve as the subject of contracts involving sale, lease, gifts, or donations? This research aims to address these critical inquiries within the framework of Sharī‘ah, contributing to the ongoing discourse on ethical and legal implications in organ transplantation.
