The Future of Capital Punishment in Pakistan: The Influence of Public Opinion, Islamic Law, and International Human Rights Standards

Abstract

The death penalty in Pakistan is a deeply debated issue, which has been shaped by the public opinion, Islamic principles, legal concerns, human rights advocacy, and alternatives to give the penalty. 20 Participants were interviewed and their perspectives explored using qualitative interviews with thematic analysis to come up with the key themes. According to the findings, some believe that death penalty serves as a necessary deterrent and practice of justice, while others express concerns of wrongful convictions, corruption and delay in judicial process of the same. This is Islamic perspectives that show how Qisas (retribution) and Diyat (forgiveness) are in the balance. There were also concerns of human rights violations and international pressure for abolition promoted, and yet some participants resisted external influence on Pakistan’s legal system. Also, wide spread support was gained for alternatives such as life imprisonment and rehabilitation programs. The study’s conclusion is that there must be legal reforms and fair trial protections if there is to be justice. Human rights implications and alternative sentencing effectiveness should be subject to future research because of public awareness of the latter.
