Abstract

This article emphasizes the critical need for reform in Pakistan’s criminal justice system to improve access to police records, which is essential for maintaining transparency and fairness in legal proceedings. Current limitations create barriers for defendants and complainants, eroding trust in the justice system. The proposal advocates for constitutional amendments and modifications to the Police Act to facilitate equitable access to police files, aligning local practices with international human rights standards. Key reforms include mandatory disclosure of witness statements and police investigation files, establishing clear guidelines for access, and defining timelines for information sharing. These changes aim to empower all parties in the legal process, promote informed participation, and reinforce the principles of a fair trial. Additionally, the article outlines proposed amendments to enhance judicial oversight, prevent the admission of undisclosed evidence, improve bail provisions, increase police accountability, and establish access to evidence as a constitutional right. Successful implementation will require collaboration among various stakeholders and public awareness initiatives to promote justice and accountability. Overall, these reforms aim to strengthen the legal framework, ensuring the protection of individual rights and fostering a transparent judicial process.
