Abstract

This study analyzed the legal frameworks regarding custodial torture in Pakistan, highlighting the gap between constitutional protections and actual practices. Using a doctrinal research methodology, it analyzes the Torture and Custodial Death (Prevention and Punishment) Act 2022, its alignment with international legal standards, and its implementation challenges. The analysis reveals critical issues, including inadequate definitions that exclude mental torture, conflicts of interest in investigative authority, insufficient resources for enforcement, and reliance on existing penal codes for punishment. The discussion underscores the need for independent oversight, specific punishments, and systemic reforms to ensure accountability and protect human rights effectively. Results indicate that while the Act is a progressive step, its potential is limited without comprehensive implementation and structural changes within the criminal justice system.
