The Relationship between Independence of Judiciary and Protection of Human Rights

The independence of the judiciary constitutes the backbone of any democratic society and serves as a prerequisite for the protection and promotion of human rights. The safeguarding of fundamental rights is contingent upon the state’s commitment to ensuring judicial autonomy; without such guarantees, the judiciary risks being susceptible to undue influence from extraneous factors, thereby undermining its capacity to protect human rights effectively (Cheema, 2016; Khan, 2018). An independent judiciary performs a vital role in fostering a just and equitable society by upholding the rule of law, resolving disputes impartially, and ensuring accountability of both the legislature and executive. In this context, judicial independence and the protection of human rights are inseparable, representing two sides of the same coin. The judiciary’s autonomy is not merely a formal constitutional principle but the foundation upon which equitable governance rests, guaranteeing that residents’ rights are recognized, respected, and defended in accordance with both national and international legal standards.
